Terms of Service — What Is It Worth

These Terms of Service govern your use of What Is It Worth — the whatisitworth.com website and the What Is It Worth iOS app — operated by WebAir AI. By accessing or using the website or app, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Overview of the Service

What Is It Worth provides AI-powered item valuations based on user-submitted photographs. Valuations are approximate estimates intended to support personal decision-making — they are not certified appraisals, financial advice, or legal assessments.

• Website: valuations are free and do not require registration.
• iOS app: includes free features plus optional paid upgrades — auto-renewing Premium subscriptions and consumable scan packs — along with accounts, saved scans and collections, cloud sync, and the Guess the Price game.

2. Accounts

Some features (saved collections, cloud sync, the leaderboard) require an account. You must be at least 13 years old to create one. You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. We may suspend or terminate accounts that violate these Terms.

Your display name may be shown publicly on the Guess the Price leaderboard in the app and on the website. Do not use a display name that is offensive, impersonates others, or contains personal information you do not want public; we may remove or rename leaderboard entries that violate this.

3. Subscriptions, Scan Packs, and Purchases

Paid upgrades are available only in the iOS app and are billed by Apple through your Apple Account. We never receive your payment card details.

• Auto-renewal: Premium subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your Apple Account is charged for renewal within 24 hours before the new period begins.
• Cancellation: manage or cancel subscriptions at any time in your Apple Account settings (Settings → your name → Subscriptions on iOS). Deleting the app or your What Is It Worth account does not cancel a subscription.
• Free trials: if a free trial is offered, it converts to a paid subscription unless canceled at least 24 hours before the trial ends. Any unused trial period is forfeited when you purchase a subscription.
• Scan packs: scan packs are consumable purchases that add a set number of scans to your account. They are consumed as you use them and do not expire while your account remains open.
• Refunds: purchases are processed by Apple, and refund requests are handled by Apple under its media services terms — request one at reportaproblem.apple.com. Except where required by law, purchases are non-refundable by WebAir AI.
• Price changes: if subscription pricing changes, Apple will notify you as required and, where required, seek your consent before the new price applies.

4. User Content and License

You retain ownership of the photographs and materials you submit. By submitting a photo for valuation, you grant WebAir AI a limited, non-exclusive license to process it — including through the third-party AI providers named in our Privacy Policy — solely to provide the valuation, detect misuse, and ensure system integrity. Photos submitted on the website are processed transiently and are not retained after your valuation completes, apart from short-lived operational logs.

If you save scans or collections in the app, you additionally grant us a license to store, host, and display that content back to you (including syncing it across your devices) for as long as you keep it saved. If you play the Guess the Price game, you grant us a license to display your display name and points publicly on the leaderboard. These licenses end when you delete the relevant content or your account, except for anonymized valuation results we retain as described in the Privacy Policy.

5. Account Deletion and Its Effects

You can delete your account at any time in the iOS app or on the website account page. Deletion removes your authentication record, profile, saved scans and collections, and leaderboard entry. Deletion is permanent — saved content cannot be recovered.

Deleting your account does not cancel an active Apple subscription (cancel it in your Apple Account settings) and does not entitle you to a refund for unused subscription time or unused scan pack credits, except where required by law.

6. Acceptable Use

You agree to use the service only for lawful purposes. You may not:

• Upload harmful, illegal, or infringing content, including violent or inappropriate imagery
• Attempt to reverse engineer, manipulate, or disrupt the service, AI models, or infrastructure
• Circumvent scan limits, rate limits, or purchase requirements
• Manipulate the leaderboard or game scoring through automated or fraudulent means
• Use outputs for professional appraisal statements, tax filings, or insurance claims
• Use outputs for legal disputes or fraudulent or deceptive purposes

7. Intellectual Property

All content, AI systems, algorithms, design elements, and branding associated with WebAir AI and What Is It Worth are owned by WebAir AI and protected by copyright and other laws. You may not reproduce, reuse, or reverse engineer the system without permission.

8. Disclaimers

Valuations are AI-generated estimates and should not be relied upon as formal appraisals or financial guidance. We do not guarantee accuracy, completeness, or fitness for any specific purpose. Market values change constantly, and actual sale prices depend on condition, authenticity, and buyer demand that a photo cannot fully capture.

The service is provided "as is" without warranties of any kind. WebAir AI is not liable for decisions made based on valuation outputs.

9. Limitation of Liability

To the fullest extent permitted by law, WebAir AI is not responsible for any indirect, incidental, or consequential damages arising from the use or inability to use the service. Our total liability will not exceed the greater of $50 USD or the amount you paid for the service in the twelve months before the claim.

10. Termination

We may suspend or terminate access at any time for misuse, abuse, or behavior that threatens security or stability. You may stop using the service or delete your account at any time. Sections of these Terms that by their nature should survive termination (including licenses for anonymized data, disclaimers, and liability limits) survive.

11. Governing Law

These Terms are governed by the laws of the State of California, excluding conflict-of-law principles. Any disputes will be resolved through binding arbitration unless otherwise required by applicable law. Nothing in these Terms limits non-waivable consumer rights in your country of residence.

12. Changes to Terms

We may update these Terms from time to time. The "Last Updated" date reflects the most recent version. Material changes may be communicated through the website or app.
